PixelPlus, MagnaChip patent dispute ends

Pixelplus Co. Ltd has issued a press release stating that the claims on the disputed contact hole process patent asserted by MagnaChip Semiconductor Ltd have been completely withdrawn from MagnaChip in Seoul High Court. Given this favorable development, MagnaChip's patent infringement claims on the contact hole process patent will no longer be contested or remain at issue.

The litigation began in April 2006 with the announcement by MagnaChip Semiconductor that its Korean operating company, MagnaChip Semiconductor Ltd, had filed a lawsuit against Pixelplus for alleged infringement of four Korean patents owned by MagnaChip.

By October of that year, Pixelplus announced that MagnaChip had withdrawn the claims, citing a mid-September ruling from the Korea Intellectual Property Office Intellectual Property Tribunal (KIPO IPT) granting its request to effectively cancel and invalidate the disputed photo diode and sensor patents claimed by MagnaChip. In a week MagnaChip had clarified that it was continuing to pursue all legal remedies for the remaining two of the original four patents it had filed in the Seoul Central District Court.

A month later, in November, MagnaChip Semiconductor filed three additional patent infringement claims against Pixelplus Co. Ltd in the Seoul Central District Court as well as a separate appeal with the KIPO IPT. The separate appeal was on one specific item out of a total of 13 separate items on the disputed photo diode patent, which, according to Pixelplus, was effectively cancelled and invalidated by KIPO.

2007 opened and Pixelplus reported that it obtained a favorable ruling from the KIPO IPT, granting its request to "effectively cancel and invalidate" a disputed contact hole process patent claimed by rival MagnaChip Semiconductor Ltd.

In February 2007 Pixelplus filed a lawsuit against MagnaChip for defamation and tortious interference with business relationships.

By August Pixelplus was cleared in MagnaChip's patent suit with the KIPO IPT confirmation that the company's sensor patent does not infringe on item 12 of the disputed sensor patent owned by MagnaChip.
