Qualcomm, Broadcom drop some patent claims

Qualcomm Inc. entered an agreement with Broadcom Corp. to dismiss with prejudice all claims and counterclaims associated with two patents of Broadcom and two patents of Qualcomm.

The agreement leads to the dismissal of a case filed at the San Diego Federal Court involving Broadcom's claims for infringement of its two now-dismissed patents. The agreement also includes the dismissal of infringement claims under two of Qualcomm's patents in another case, also pending at the same court. Meanwhile, the agreement does not affect the remaining patent infringement claims between the two parties in the federal courts in San Diego and Orange County, California.

The two dismissed Broadcom patents were among five that Broadcom initially asserted in complaints filed in May 2005 in the U.S. International Trade Commission (ITC) and in the federal court in Orange County. Broadcom claimed that the two patents relate to Bluetooth technology implemented in cellphones and cellular systems.

The two Qualcomm patents affected by the agreement were among five Qualcomm patents and four Broadcom patents remaining in a separate lawsuit filed in San Diego Federal Court in July 2005. These patents were divided into five separate jury trials scheduled throughout 2007. The dismissal of the two Qualcomm patents and related claims and counterclaims will eliminate one of the five scheduled trials.
