Spansion, Macronix settle trademark infringement suit

Spansion Inc. and Taiwan's Macronix International Co. Ltd announced the resolution of litigation the between the parties commenced by Spansion LLC, a subsidiary of Spansion, involving claims of false advertising, trademark dilution and copyright violations.

The parties have agreed to settle the dispute on undisclosed terms, and Spansion has dismissed the litigation with prejudice. Spansion charged Macronix last year of deceiving customers into believing that it is an authorized second source for Spansion Mirrorbit products.

"We are pleased to have reached a resolution of the litigation with Macronix regarding the intellectual property rights of Spansion in the MirrorBit brand," said Robert Melendres, executive vice president and chief legal officer for Spansion.

"Macronix has invested tremendously in its own trademarked products in the flash marketplace, and it's Macronix consistent position to respect the trademarks of other companies in the industry," said Billie Chen, director of intellectual property and legal office of Macronix.
