U.S. Court of Appeals dismisses Qualcomm ban appeal

The U.S. Court of Appeals July 20 dismissed Qualcomm Inc.'s appeal on the International Trade Commission (ITC) ruling banning some mobile phones containing Qualcomm chipsets in the United States, according to a Reuters report.

The court said it dismissed the appeal due to lack of jurisdiction over the June 21 ITC order. The court, however, clarified that an ITC ruling does not become final for judicial review purposes until the U.S. President has approved it or failed to disapprove within 60 days.

The ITC order came following a May 29 federal jury ruling that Qualcomm has infringed Broadcom Corp. patents. In a recent company release, the embattled company said it is continuing to work with its partners on seeking a presidential veto on the ban.
