Qualcomm general counsel resigns

Qualcomm Inc. announced Aug. 13 that Lou Lupin has resigned as executive VP and general counsel for the wireless chip developer. Carol Lam, senior VP and legal counsel, will serve as acting general counsel while a nationwide executive search is conducted for a new general counsel. Lam joined the company in February this year.

Lupin has contributed "in the formation of Qualcomm's successful technology licensing program and negotiation of key licensing agreements," Qualcomm CEO Paul Jacobs said in a statement, adding that the outgoing executive's "direction on legal matters and intellectual property expertise and strategy has greatly benefited" Qualcomm.

Lupin's resignation comes shortly after Qualcomm suffered critical blows in several of its patent litigation, the most controversial of which was its long-drawn-out war with Broadcom Corp. that concluded in May after a federal jury found its baseband chips had infringed on patents owned by the latter. These particular chips as well as cellphones using them were then ordered banned by the U.S. ITC from entry into the United States. Qualcomm had appealed to U.S. President Bush to veto the ITC ruling but the White House decided to uphold it.

In another patent dispute with Broadcom, Qualcomm was stripped of its rights to two patents relating to digital video technology, after the court found it had engaged in aggravated litigation misconduct and standards abuse.

Qualcomm also has an ongoing patent dispute with top cellphone maker Nokia.
